IshanyaTerms of Service
Welcome to Ishanya. These Terms of Service (“Terms”) are a legal agreement between you and Orkids Group LLC governing your use of the Ishanya mobile app and related services (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Who can use Ishanya
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use Ishanya, and you must be able to form a binding contract. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for it.
2. What Ishanya is
Ishanya is a Vedic astrology app and marketplace. It:
- generates birth charts, panchanga (almanac) data, and related calculations;
- produces AI-assisted astrological readings; and
- connects people seeking guidance (“Jatakas”) with astrologers (“Jyotishis”) for consultations.
Ishanya is a platform, not a party to consultations. Jyotishis are independent users, not our employees or agents. We do not provide astrological services ourselves, do not endorse or guarantee any Jyotishi, and are not responsible for the content, quality, timing, or outcome of any consultation.
3. Your account
- Provide accurate information and keep it current.
- You are responsible for keeping your password confidential and for all activity under your account.
- Tell us promptly at [email protected] if you suspect unauthorized use.
- One person, one account, unless we agree otherwise. You may hold both Jataka and Jyotishi roles on a single account where the app allows it.
4. Acceptable use
You agree not to:
- break the law, infringe others' rights, or violate these Terms;
- upload content that is unlawful, fraudulent, harassing, hateful, obscene, or that impersonates another person;
- submit birth details or other information about another person without the right to do so;
- probe, scrape, overload, reverse-engineer, or interfere with the Service or its security;
- use the Service to build a competing dataset or service, or resell it, without our written permission;
- misuse the AI features (e.g., attempts to extract the underlying model, generate prohibited content, or evade usage limits).
We may remove content and suspend or terminate accounts that violate these Terms.
5. Content and licenses
Your content. You keep ownership of the content you submit (birth details, profile information, messages, articles, sample work, etc.). You grant Ishanya a worldwide, non-exclusive, royalty-free license to host, store, process, display, and transmit your content solely to operate and provide the Service — for example, to compute your charts, show a Jyotishi's public profile, or deliver a consultation. Jyotishis grant the additional license needed to display their public profile and articles to other users.
Our content. The Service itself — software, design, text, logos, and the “Ishanya” name — is owned by Orkids Group LLC or our licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to use the app for its intended purpose. You may not copy, modify, or create derivative works of the Service except as allowed by law.
Readings. Charts and readings you generate are yours to use for personal, non-commercial purposes.
6. AI-assisted readings
AI readings are generated using a third-party AI provider (see the Privacy Policy). They can be inaccurate, incomplete, or inconsistent, and are provided “as is” for information, reflection, and entertainment. They are not a substitute for professional advice. You are responsible for how you use them.
7. Consultations and the marketplace
- Jatakas may request paid, free, or “Direct” consultations from Jyotishis. Direct consultations are arranged and conducted off-platform; when a connection is made, contact details are shared between the parties so they can arrange the session. Ishanya is not involved in and not responsible for Direct consultations, including any payment or conduct.
- Jyotishis set their own fees, availability, systems, and languages, and are solely responsible for the accuracy of their profiles, their conduct, the services they provide, and their compliance with applicable laws, licensing, and taxes.
- We may review, approve, suspend, or remove Jyotishi profiles, but we do not vet, certify, or guarantee any Jyotishi and make no representation about their qualifications.
- Interactions between users are between those users. To the extent permitted by law, Ishanya is not liable for disputes, losses, or harm arising from user interactions.
8. Payments, purchases, and refunds
AI readings (In-App Purchase). AI readings are sold as consumable in-app purchases through Apple. Payment is charged to your Apple ID, and Apple's terms apply. Refunds for App Store purchases are handled by Apple under Apple's policies — request them through Apple. Because AI readings are delivered digitally and consumed on generation, they are otherwise non-refundable except where required by law.
Consultations (Stripe). Paid consultations are processed through Stripe. By purchasing, you authorize the applicable charge. Jyotishi payouts are made through Stripe Connect. Fees, currencies, and any platform commission are shown at the time of purchase.
Direct consultations. Any payment for a Direct consultation is arranged solely between you and the Jyotishi. Ishanya does not process it and is not responsible for it.
Taxes. You are responsible for any taxes on your purchases. Jyotishis are responsible for reporting and paying taxes on their earnings.
9. Third-party services
The Service relies on third parties (Apple, Stripe, our AI, hosting, and email providers). Your use of those services may be subject to their own terms, and we are not responsible for them.
10. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure, or if we discontinue the Service. Sections that by their nature should survive termination (including content licenses granted to operate the Service, disclaimers, limitation of liability, and dispute terms) will survive.
11. Disclaimers
THE SERVICE, INCLUDING ALL CHARTS, PANCHANGA, AND AI-ASSISTED READINGS, IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any reading, calculation, or Jyotishi will meet your expectations.
Astrological content is for cultural, informational, and entertainment purposes only and is not medical, legal, financial, psychological, or other professional advice. Do not delay or disregard professional advice because of anything you read in the app.
12. Limitation of liability
To the maximum extent permitted by law, Orkids Group LLC and its owners, officers, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or other intangible losses, arising from or related to your use of (or inability to use) the Service.
To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) US $50.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless Orkids Group LLC from claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right — including, for Jyotishis, claims arising from the consultations you provide.
14. Changes to the Service and to these Terms
We may modify or discontinue features at any time. We may update these Terms; when changes are material, we will update the “Last updated” date and notify you in the app or by email. Changes take effect when posted (or on a stated later date). Continuing to use the Service after changes take effect means you accept the revised Terms.
15. Apple-required terms (iOS users)
These Terms are between you and Orkids Group LLC only, not with Apple. Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the app (including product-liability, legal/regulatory, or consumer-protection claims). Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a U.S.-embargoed country or on a U.S. government restricted-parties list, and you will comply with applicable third-party app-store terms.
16. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Texas have exclusive jurisdiction, except that either party may seek injunctive relief in any competent court to protect intellectual property or confidential information. If any provision of these Terms is unenforceable, the rest remains in effect.
17. General
These Terms and the Privacy Policy are the entire agreement between you and us about the Service. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or successor. Nothing here creates a partnership, employment, or agency relationship between you and us.
